Terms and Conditions of Use
1. Description of Services
AdsPepper (“AdsPepper”) is dedicated to facilitating negotiations and connections between brands and content creators, acting exclusively as an intermediary. AdsPepper is committed to providing its services professionally and in strict compliance with the applicable laws of each country.
2. Campaign Commission
AdsPepper charges a negotiated commission, which may vary between 10% and 30% of the value of each successfully managed campaign. This commission will be deducted from the payment made to content creators, with the brand responsible for completing the full payment to AdsPepper.
3. Payment Reconsideration
In cases where the brand considers that the promotional style does not meet its expectations or that its image has been compromised, it may request a reconsideration of payment and will be required to pay only 50% of the initially agreed amount. The content creator, in this case, will accept receiving only 50% of their payment unless they believe the campaign has met the agreed-upon principles of ethics and professionalism. In such cases, the creator reserves the right to claim the total negotiated amount.
4. Off-Platform Negotiations
Negotiations or agreements may take place outside the platform and through other means, whether physical or digital, provided both parties agree.
5. Use of Contact Information
AdsPepper collects contact information from content creators and brand representatives solely to facilitate communication between the interested parties. AdsPepper does not market, sell, or exploit this information for other purposes and uses it solely to fulfill its role as an intermediary.
6. Use of Third-Party Technology
For the administration, storage, and management of the collected information, AdsPepper uses third-party services, including Make.com, Google, Hostinger, Microsoft, and Meta. AdsPepper has no control over how these entities may use the provided information and advises users to review and understand the privacy policies and terms of use of these services.
7. Exclusivity and Limitation of Liability
AdsPepper does not guarantee specific results, such as sales, follower growth, or immediate improvements. AdsPepper’s role is to facilitate contact and negotiation between the parties, without guaranteeing a specific success rate in collaborations. All information and interactions between the parties remain at their own risk and discretion.
8. Privacy and Security
AdsPepper is committed to maintaining information under strict privacy and security policies, both in physical and digital media, in compliance with the applicable regulations of each country. Any valid governmental request for information will be addressed cooperatively, always within the legal framework.
9. Limitation of Responsibility
AdsPepper reserves the right to decline negotiations with any individual or entity without justification. AdsPepper will not work with individuals who feel pressured by third parties nor with minors. Users are required to verify their age of majority to access services.
10. Protection of Third-Party Intellectual Property
AdsPepper does not assume ownership rights over names, logos, or trademarks of third parties. Should any brand or entity feel that its image has been compromised, it is invited to contact AdsPepper for appropriate resolution.
11. Responsibility for Shared Information
Each user is responsible for the information they provide through AdsPepper. Brand representatives are responsible for the information provided by the creators and for its use. AdsPepper is not responsible for the misuse of information outside its control.
12. Ethical Commitment
AdsPepper does not promote or facilitate any illegal activity nor will it profit sexually from any activity or content. AdsPepper also reserves the right to deny services to any entity that does not meet these standards.
13. Exclusive Trademark Rights
AdsPepper has an active and prioritized presence in the U.S. market, granting it exclusive rights to use the trade name in this territory. AdsPepper reserves the right to protect the brand and take legal action against any attempt at unauthorized use.
